Rental Terms and Conditions

Rental Terms and Conditions (“Rental T&C”) govern the rental agreement offered by Muzny Studio and Events LLC, a Texas limited liability company (“we,” “us,” or “our”), operating a photography studio located in Spring, Texas under the name The Creative Photographer.


Muzny Studio and Events LLC hereby provides a limited and revocable license for use of the “Studio” located at 1104 Rayford Rd, Suite 800, Spring, TX 77386. This agreement applies to every instance the Renter utilizes the studio location. 

“Studio” is The Creative Photographer and includes the studio premises and any additional areas leased by Muzny Studio and Events LLC; “Renter” is the person or business renting the Studio, also mentioned as “Client Name” above.

Please note: the Studio is under 24 hr surveillance for security and safety purposes

PRICING

All studio Standard Weekday Rentals, Standard Weekend Rentals, Themed Set Rentals, other Rentals, and any additional charges are displayed at the time of booking or purchase. The Creative Photographer may update pricing at any time. The price shown at checkout is the binding price for that specific booking.

RENTAL TIME

Renter’s rental time will begin immediately at the pre-arranged starting time and will end immediately upon the pre-arranged ending time outlined in the contract. The door will not be accessible until the start of your rental. Rental time must include any set-up, breakdown and cleanup so please rent your time accordingly. Renter must have Studio cleaned, props put back where they are found and ready to exit the premises by the pre-arranged ending time. Renter will be charged $10 per minute for every minute that they are still in the building after their rental has ended. Most of the time rentals are booked back to back. Please do not arrive any earlier than 10 minutes prior to when your rental is set to begin. 

 If Renter wishes to add additional time they may contact the Studio Manager. There is no guarantee that additional time can be granted. If it can, the invoice for this time must be paid onsite before Renter has left the Studio. If Renter fails to pay before leaving the Studio, the Renters card on file will be charged accordingly. Reservations can not be pushed back to start at a later time if Renter is running late. In the event the Renter is running late, more time would need to be added on or the Renter must still exit the Studio at the scheduled time.

RESCHEDULES AND CANCELLATIONS

A $25 rescheduling fee will be charged if Renter chooses to reschedule or change a rental. Cancellations will result in the forfeit of the Renters deposit. All other payments made to the Studio will be refunded. If the Studio must cancel Renter’s reservation, Renter will be given a full refund. Studio is not liable for acts out of its control that affect the rental, such as building equipment failures, power outages, weather, acts of God or emergencies. In such cases, Studio will refund a prorated portion of Renter’s payment. If Renter fails to show up in the first 30 minutes of their scheduled rental they will be considered a No Show and no refunds will be given.

In case of illness by the renter or anyone in renters party, the rental must be rescheduled. In this case, there will not be a fee for rescheduling.

USE OF STUDIO/STORAGE/PROPS 

Studio may be used for photography and videography. Studio may be used only for legal business activities. Rental includes sole access to the Studio in its entirety. This Studio is comprised of one big open space with multiple sets to photograph your clients as well as a storage area with props for each Renter to use. 

Large outside props, not provided by the Studio must be approved by the Studio Manager via email before the rental begins. The Studio is not responsible for any lost or missing items/props by the Renter or anyone in their party. 

A small stool or ladder will be provided by the Studio in the event objects need to be reached from a high place. Standing on furniture or props is not permitted.

Food and alcohol are NOT allowed in the Studio with the exception of what is necessary for a cake smash session. Please limit any drinks to water or clear liquids as they can stain the concrete if spilled.

Studio will dispose of trash in restrooms but Renter is responsible for taking and disposing of all food/drink related trash in the large rolling trash bin in the storage area. Renter agrees to leave the Studio clean and tidy as it was upon arrival. Renter must discard larger items, such as personal props and set pieces. All items brought to the Studio by Renter are to be removed by Renter. Items left after 7 days will be assumed as abandoned and may be discarded or kept by the Studio for Studio use, with no compensation due the Renter, at the discretion of the Studio. If Renter does not return the Studio to the order and cleanliness found when Renter arrived, Studio will charge at minimum a $150 cleaning fee.

STUDIO RULES

  • No dragging of any furniture pieces or props across the floors. Floors will be checked after each rental. Furniture dollies are available in the storage area.
  • No standing on chairs or props. Short stools are provided in the storage area for use.
  • All props taken from the storage area or moved around during your rental must be put back where you found them.
  • No sand, glitter, sparklers, oil based sprays, smoke bombs or confetti allowed in the Studio. 
  • Cake smashes are allowed but please bring a towel/blanket/rug to put under the cake or use the white floor panels provided by the Studio. 
  • The use of alcohol is strictly prohibited unless permission is given in writing by studio management. No non-prescription or illegal drugs are allowed on premises. 
  • Music/voices are to be kept at reasonable levels, and the door closed at all times. 
  • No one will be admitted who is drunk or under the influence of illegal substances. 
  • No unattended minors allowed in the studio. 
  • No pets are allowed in the studio.
  • There is absolutely NO SMOKING in the studio or just outside the building premises. Smoking is allowed outside the Studio at a designated space 25 ft from the main building. Renter is responsible for cleanup of smoking related debris (ashes, cigarettes, etc.) before leaving. Failure to adhere to these rules will result in immediate termination of your rental without refund or Studio credit, and will render you ineligible to rent the studio in the future.
  • Studio thermostat is not allowed to be changed during your rental. If you need it changed, please text the number to the Studio Manager in your email.
  • Please turn off all lights in the Studio before leaving the premises.
  • Under no circumstance may you share the code to access the Studio with anyone outside of our rental agreement. Please do not share the code with your clients or other future renters.

PROHIBITED ITEMS

Absolutely no glitter, confetti, confetti balloons, smoke bombs, sparklers, flower petals or sand are allowed inside/outside of the studio. Your session will be terminated immediately, without refund or studio credit, and a fee of at least $150 will be assessed for cleanup, re-treatment of the Studio floor and lost rental time if either of these substances are found in the Studio. Renter shall notify Studio Manager immediately of any uncleanliness or damage in the Studio prior to the rental start time. 


CAKE SMASH SESSIONS

Renter must abide by Studio rules in regards to cake smash sessions being held in the Studio. Cakes are not allowed to be placed directly on the concrete floor. White floor panels (provided by the studio) must be used or the drop down seamless paper. All traces of cake/food and residue must be gone and cleaned up properly. Studio does provide the proper cleaners for this and can be found in the storage area. If the Studio is not properly cleaned, a $200 cleaning fee will be charged at the Studio’s discretion.

PARKING/ENTRY 

Parking is directly in front of the building. Please enter through the Front Door. Code access will only work on the Front Door. The back door is an exit only and you will not have access to re-enter the building unless you access through the Front Door.

CONDUCT 

The Renter must conduct themselves in a professional manner at all times which includes any persons that accompany the Renter. Children must be supervised at all times to ensure the safe use of the Studio equipment, and to mitigate any preventable injury or damage to the studio/equipment. The Renter shall be solely responsible for the conduct and welfare of all persons accompanying Renter. Renter agrees that a Studio representative may, at the Studio’s sole discretion, be present at all times. If the representative observes or otherwise becomes aware of dangerous, pornographic, illegal or negligent practices or activities, the representative reserves the right to stop the rental and may require Renter and Renter’s party to leave immediately. The authorities will be alerted to any illegal activities witnessed by the Studio representative. In such cases no refund will be given for unused time. However, Studio and its representatives assume no responsibility to act in such cases. 

**All rooms in the studio are under complete 24 hour video surveillance at all times (with the exception of the restroom areas). Please keep wardrobe changes restricted to the restrooms to ensure privacy.** 

Studio representatives shall have the right to inspect the equipment and/or Studio at any time during the rental term. Renter shall make any and all arrangements necessary to permit an employee of the Studio access to the equipment and/or Studio. If a breach of any of the provisions of the Rental Agreement occurs, the Studio has the right to revoke your access to the equipment and/or Studio.

EQUIPMENT 

The Studio agrees to provide equipment in good working order, but makes no special guarantees as to said equipment’s functionality or suitability to Renter’s purposes and is not liable for acts out of its control that affect the shoot, such as power outages, weather or emergencies. In such cases, Studio will offer studio credit for bookings that have been scheduled and are not able to complete. Renter agrees to return all equipment in the condition it was provided and to notify studio manager of any damage, failure or change in equipment provided. 

DAMAGE OF PROPERTY/PROPS

Renter shall be solely responsible for any damage to Studio’s property or equipment that occurs during the time Renter or Renter’s guests occupies the Studio. Damage deposits will be held until repairs can be made. If the damage exceeds the amount of the damage deposit, Renter agrees to pay reasonable, additional repair costs to bring damaged equipment back to working condition. Renter agrees to pay for damage to the Studio including spills, excessive wear, marks or stains on furniture, broken furniture or fixtures, painted surfaces or floors and damage to equipment. 

FEES

The Renter knowingly and voluntarily waives the right to dispute any and all credit/debit card charges pertaining to this rental, associated fees and/or damages and agrees that any and all credit/debit card charges shall not be disputed. Any conflict or disagreement of these credit card charges related to this reservation shall be resolved through arbitration in Montgomery County. The Renter also agrees and authorizes The Creative Photographer to charge their credit card for any and all additional charges that relate to damage, overage time, pets, additional cleaning, additional or unauthorized guests.

LIABILITY 

Use of The Studio and outdoor space of studio premises is at Renters risk. Renter hereby agrees that Studio will not be held liable for any direct, indirect, incidental or consequential damage, injury or loss to Renter, his party or possessions. Renter holds harmless and indemnifies Studio, and/or its owners, agents, representatives, associates, officers, employees, guests and tenants against any suit, claim, loss, accident, judgment, fine, injury, damages or death including attorney’s fees. This indemnification shall continue in full force and effect during and after the term of the rental for such causes arising during the term of the rental. 

Renter agrees to and assumes all liabilities within this agreement for all persons, models or employees of Renter on Studio premises. The Studio will not be held liable for any injuries or accidents to the Renter or anyone in Renter’s accompanying party that occur within or outside the Studio premises. Any personal items brought into the Studio space are the sole responsibility of the Renter. The Studio is not responsible for personal belongings left/lost at the studio. The Renter agrees to use models of legal age (>18 years old) when using the Studio space or require a parent or guardian on site. The Renter agrees that he/she is fully responsible for ensuring the validity of age verification the model produces. The Renter agrees that he/she cannot hold The Studio liable in the case of an invalid ID or any other form of age validation. The Renter agrees to furnish proof of parental consent in the case that the model is under the age of 18 years. 

If The Studio finds it necessary to require General Liability Insurance the following minimums will apply: 

Commercial General Liability deemed primary and non-contributory. $1,000,000 Per Occurrence and Annual Aggregate must name The Creative Photographer, LLC as an additional insured party.
