Membership Terms and Conditions (“Membership T&C”) govern the membership program offered by Muzny Studio and Events LLC, a Texas limited liability company (“we,” “us,” or “our”), operating a photography studio located in Spring, Texas under the name The Creative Photographer. By purchasing a Membership, you (“Member” or “Client”) agree to be bound by these Membership T&C. These Membership T&C are effective as of the date of your Membership purchase.
These Membership Terms and Conditions (Membership T&C) operate in addition to the Studio’s standard Rental Terms & Conditions (“Rental T&C”). By purchasing a Membership, the Member agrees to comply with both these Membership T&C and the Rental T&C. In the event of a conflict, the Rental T&C governs all matters related to studio use, conduct, safety, and rental policies.
For purposes of these T&C:
Subscription Start and Free Hours Activation
Subscriptions commence on the date of purchase and continue for the duration of the selected term. Members may choose to activate their Free Hours either (a) during the month in which the subscription is purchased, or (b) on the 1st day of the following month. If a Member uses any Free Hours during the purchase month, that month will be deemed the official start of the Member’s Free Hours cycle. Monthly subscription payments correspond to the designated Free Hours month based on the Member’s selected activation date.
The Creative Photographer offers three Membership Tiers—Creator available for a 6‑month Term, Photographer available for a 6‑month Term, and Elite available for a 6‑month or 12‑month Term.
Membership pricing is determined by the rates in effect at the time of purchase. All prices are in U.S. dollars and exclude applicable taxes unless otherwise stated. Payment is due in full at the time of purchase. Membership fees are non‑refundable, except where required by applicable law.
A Membership begins on the date of purchase and continues for the selected Term. Memberships do not automatically renew.
To continue Membership after the Term ends, the Member must contact The Creative Photographer to select a new Term and/or Tier. Renewal is subject to the T&C and pricing in effect at the time of renewal. If the Member does not renew before the Term ends, all Benefits expire, and a new Membership must be purchased through the website.
Members may cancel their Membership by providing 30 days’ written notice. No refunds will be issued for any unused portion of the Term. Members may continue to use Benefits until the start of the next billing cycle following the cancellation date.
For the Photographer and Elite Tiers, where Flexible Hours are provided upfront, Members who cancel early must pay for Excessive Hours used at the end of Membership after the cancellation date. Excessive Hours are the number of studio rental hours used by a Member in excess of the prorated Flexible Hours earned as of the end of membership after the cancellation date. Excessive Hours apply only when a Member cancels before the end of the Term. Each Excessive Hour will be billed at the discounted hourly rate applicable to the Member’s Tier listed below based on the listed benefits – Photographer: 35% off the original rental price at the time of the appointment minus the $25 paid. Elite: 50% off the original rental price at the time of the appointment.
Excessive Hours are calculated as the number of completed Free Hours used beyond the prorated Flexible Hours earned as of the end of membership after the cancellation date. Excessive Hours apply only to Members who cancel before the end of the Term.
The Creative Photographer may terminate a Membership immediately for any violation of these T&C, the Studio’s Rental Terms & Conditions, Studio policies, or applicable laws. Upon termination, all Membership Benefits—including unused Free Hours and future bookings—may be revoked. Payments made for future appointments will be refunded; Membership fees will not.
The Creative Photographer may modify these MembershipT&C at any time. Updated Membership T&C will be posted on our website and/or communicated via email. Changes will not affect the current Term of an active Membership; however, any renewal or new Membership purchase will be governed by the Membership T&C in effect at that time.
To the fullest extent permitted by law, The Creative Photographer is not liable for indirect, incidental, special, punitive, or consequential damages arising from Membership or use of Benefits. Our total liability shall not exceed the amount paid by the Member for the current Membership Term.
These Membership T&C are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the state or federal courts located in Montgomery County, Texas.
